History of Labor Day
Labor Day is truly a global holiday, or as it is known internationally May Day. The roots of Labor Day stretch back to the 1810’s and what was known as the eight hour day movement. Robert Owen, as early as 1817 had formulated the goal of the eight-hour day and coined the slogan Eight hours labor, Eight hours recreation, Eight hours rest.

In the new founded Wellington colony in 1840, the carpenter Samuel Parnell refused to work more than eight hours a day. This movement also began in Australia, when the Stonemasons stopped working and proceeded to march on Parliament from the University of Melbourne, to achieve an eight hour work day. This movement eventually found its way to Canada as well, and Labor Day in Canada as well as the United States can be attributed directly to the efforts of the Knights of Labor.

The Knights of Labor was labor union founded in secrecy in December 1869, by a group of Philadelphia tailors led by Uriah S. Stephens. Originally called 'The Noble and Holy Order of the Knights of Labor', it was designed to protect all who worked for a living. They organized a parade by on September 5, 1882 in New York City which became an annual parade when it was organized a second time in 1884.

The International Workingmen's Association, many of whom were socialists or anarchists, favored a May 1 holiday. With the event of Chicago's Haymarket riots in early May of 1886, president Grover Cleveland believed that a May 1 holiday could become an opportunity to commemorate the riots. Thus, fearing that it might strengthen the socialist movement, he quickly moved in 1887 to support the position of the Knights of Labor and their date for Labor Day.
Since then, Labor Day has been celebrated on the first Monday in September in the United States since the 1880s. The September date has remained unchanged, even though the government was encouraged to adopt May 1 as Labor Day, the date celebrated by the majority of the world. 2007 TREPAC Best of the West REALTOR® Rodeo Great FUN!
Fun was had by the 400 North Texas REALTOR® members and friends who attended the TREPAC Best of the West REALTOR® Rodeo last Saturday, August 18 in the Fort Worth Stockyards. In all, seven local associations participated. As of yesterday, TREPAC investments totaled over $37,000.

Events included B-B-Q dinner, live and silent auctions, live rodeo action and an honest to goodness ‘Calf Dressin’ Contest’ between the seven associations and TAR. Honorary Event Chair - Texas Commissioner of Agriculture, Todd Staples, gave a personal testimony as to what TREPAC funds and REALTOR® grassroots involvement has meant to his political career!

This is the second year that CCAR has participated in this event. Our local advertisers making the event possible were Keller Williams Realty and Perma-Pier Foundation Repair Company. A bus was provided by Tucker Hill, A Southern Land Co. Company. Many of our very special elected officials contributed auction items.

Oh, and by the way, our very own ‘Calf Dressin’ Team’ (Rebecca Ray, Toby Lovett, Marcia Wilkicki, Coyle Beard and Doug Smith) came in a VERY close second place. Too bad there were no replay cameras!

We are already looking forward to next year’s event. Hope to see you there!

NTREIS RULES AND REGULATIONS WEEKLY REVIEW

SECTION 8 – SELLING PROCEDURES  

8.02 – Appointments for showing Listed Property shall be conducted exclusively through the Listing Participant.  The Listing Participant may authorize the Other Participant to show the Listed Property as indicated in the showing instructions or showing features field.  If after reasonable effort, the Other Participant is unable to contact the Listing Participant or his/her representative, then in that event, the Other Participant may make direct contact with the owner only for the purpose of showing Listed Property.

Always set up showings through the appointed showing service that is listed in the Agent Full Report.  If you cannot get confirmation to show and have exhausted every possible route, then it is alright to contact the owner to SHOW the property only.  Additionally, as a Listing Agent, always keep your showing instructions updated so that Other Participants know what to expect when showing one of your listings.

This year’s Texas REALTORS® Convention sets up shop September 7-11 in Galveston. As always, the convention and trade expo gives you countless opportunities to renew old friendships and make new ones with fellow REALTORS® from across the state, listen to some of the most dynamic speakers in the country, pick up a few MCE credits while learning the latest industry trends, attend a party or two (or more), and check out the fantastic vendors at the trade expo.

New Seller's Disclosure Requirements - Effective 9/1/2007

You and your members should be aware of two recent legal issues: new seller's disclosure requirements and progress on MLS data disclosure.

New seller's disclosure requirements

An important article in the August Texas REALTOR® magazine, "No smoke and mirrors—just a new disclosure notice," contains information that members need to know regarding disclosure and installation of smoke-detection equipment in certain homes. You can **read the article online at TexasRealtors.com. Also, answers to common questions on the revised seller's disclosure requirements as well as the new smoke-detector requirements for homes in Texas have been added to the Legal FAQs section of TexasRealtor.com (TexasRealtors.com login required). Feel free to use both resources to inform your members of the changes in law.

**No smoke and mirrors—just a new disclosure Notice

New requirements take effect September 1.

The Texas Legislature has imposed new fire-safety requirements on owners, sellers, and landlords of residential real property that you and your clients need to be aware of to comply with the law. The requirements affect the information sellers must disclose as well as steps sellers might be required to take. The new language also places a duty on a landlord of property that is a one- or two-family dwelling unit. The new law, enacted as House Bill 2118, takes effect Sept. 1, 2007.

Under the new law, a seller of a single-family residence will now be required to disclose information regarding the presence of fire-detection and safety devices in the residence. The items that must be disclosed include smoke detectors, hearing-impaired smoke detectors, carbon monoxide detectors, and emergency escape ladders. These changes have already been made to the Texas Association of REALTORS® Seller’s Disclosure Notice (TAR 1406).

While the fire-safety information is not required to be given until September 1, it is recommended sellers begin using the new notice form immediately to avoid having to update the notice if the listing does not go under contract before September 1.

House Bill 2118 also sets out new fire-safety requirements for sellers of one- and two-family dwellings. Under the new law, a purchaser under a written contract for the sale of a one- or two-family dwelling may require the seller to install smoke detectors equipped for hearing-impaired persons prior to the closing date of the sale of the home. In order to impose this requirement on the seller, the purchaser must satisfy two requirements. First, the purchaser must provide to the seller written proof signed by a licensed physician of the hearing-impairment of the purchaser or a member of the purchaser’s family who will reside in the residence. Second, not later than the 10th day after the effective date of the contract, the purchaser must request, in writing, installation of the hearing-impaired smoke detectors by the seller. The law authorizes the seller and buyer to agree which party will bear the cost of the smoke detectors and which brand will be installed. If a seller fails to install the smoke detectors as required, the purchaser may terminate the contract.

Smoke detectors required

The legislation also imposes smoke-detector require-ments on certain dwellings. The change in law requires all owners of one- and two-family dwellings constructed in Texas to have working smoke detectors installed in accordance with the requirements of the building code in effect in the area in which the dwelling is located. This requirement extends to a landlord of a one- or two-family dwelling unit and satisfies the requirements of the current smoke-detector laws applicable to landlords.

Lastly, the change in the law requires that a permit issued for a home improvement include the installation of smoke detectors in accordance with the local building code if the dwelling for which the permit will be issued does not comply. If you are asked by a client for the local building code requirements, you should direct the client to contact local building officials in your area for more information.

Reducing risk does not pertain only to your business practices. Protecting properties from fires is an important aspect of homeownership and leasing, and complying with the new disclosure requirements will help keep more Texans safe in their homes.

TAR adopted final revisions to the following forms.  Two of the forms (1918 and 1927) are new.

                1916 – Addendum for Property Located Seaward of the Gulf Intracoastal Waterway

                1927 – Addendum to New Home Contract Containing Required Notices under 27.007, 420.001 and 420.002, Property Code

                2301 – Independent Contractor Agreement for Sales Associate

                2302 – Statement of Understanding

                2506 – Inspector Information

A task force of the Risk Reduction Committee recommended that TAR adopt the revisions and new forms.  Drafts of the proposed forms were previously sent to the local associations requesting comments.  Please thank your members for their comments.

The form-fill vendors should update their libraries in the next 30 to 45 days.  The forms are available on TAR’s Web site.

Form 1927 is being adopted without comment as it is required by a bill that passed this session (HB 1038, which amended many sections of the Property Code that concern builders).  We believe that the text of Form 1927 will eventually be included in the text of the new-home forms and the new-condominium forms.  However, due to the need to publish this notice immediately, TAR is creating Form 1927 as a separate notice that should be attached to the new-home contracts and new-condominium contracts.  In order to trigger appropriate use of the form, the form will appear in the file of the new-home contract forms and the new-condominium contract forms as the last page.

Form 1916 was revised without comment because of a bill that revised that notice (HB 2819).  The existing notice concerning properties located seaward of the Intracoastal Waterway was promulgated by TREC.  However, it does not appear as though TREC will be able to adopt a revised form prior to the effective date of the bill.  Therefore, TAR is temporarily replacing the TREC version of Form 1916 with the revised version.  We will eventually use the TREC version of this form after TREC revises its form.
